Sudanese legal experts and rights defenders have strongly criticised the latest report by the International Criminal Court (ICC) to the UN Security Council, calling it a \u201cchronic failure\u201d in delivering justice for victims of atrocities in Darfur over the past two decades.<\/strong><\/p>\n\n\n\n

In the July 10 briefing<\/a>, Deputy Prosecutor Nuzhat Shameem Khan updated the Council on the situation in Sudan. Sudanese lawyer and legal expert Saleh Mahmoud told Radio Dabanga that the report \u201clacks seriousness and tangible results,\u201d noting that since the referral of the Darfur file to the Court in 2005 under UN Security Council Resolution 1593<\/a>, only one suspect, Ali Kushayb<\/a>, has been brought to trial.<\/p>\n\n\n\n

\u201cThis is an institutional failure and a waste of the Court\u2019s resources,\u201d Mahmoud said, pointing out that prominent indictees<\/a> such as ousted president Omar Al Bashir<\/a>, Ahmed Haroun<\/a>, and Abdelrahim Hussein remain at large.<\/p>\n\n\n\n

Mahmoud also questioned the absence of ICC Prosecutor Karim Khan from the briefing, calling it \u201can evasion of responsibility\u201d and expressing disappointment over unfulfilled promises to deliver progress on investigations in El Geneina and El Fasher<\/a>. He urged the Security Council to take stronger action, including replacing the prosecutor if necessary.<\/p>\n\n\n\n

Lawyer and rights activist Moez Hadra meanwhile described the report as \u201cwithout teeth.\u201d He said it recycles old pledges while failing to deliver justice. \u201cTwenty years on, victims have lost faith in the Court\u2019s seriousness,\u201d Hadra told Dabanga.<\/p>\n\n\n\n

Hadra called for expanding the ICC\u2019s jurisdiction to cover atrocities committed beyond Darfur since the outbreak of the Sudan war on April 15, 2023. \u201cThe crimes now include Khartoum, Kordofan, and other areas. Why should investigations remain confined to Darfur?\u201d<\/p>\n\n\n\n

Lawyer Osman Saleh cited limited financial and human resources as reasons for the Court\u2019s narrow focus on North and West Darfur, despite widespread violations across the region. He stressed the role of civil society in supporting documentation and investigations.<\/p>\n\n\n\n

ICC report<\/strong><\/p>\n\n\n\n

As previously covered by Dabanga, the ICC prosecutor’s 41st report to the United Nations<\/a> Security Council detailed ongoing war crimes and crimes against humanity in Darfur, warning that the scale of atrocities demands urgent international action. <\/p>\n\n\n\n

The ICC<\/a>\u00a0said it had \u201creasonable grounds to believe\u201d that such crimes \u201ccontinue to be committed in Darfur,\u201d amid 27 months of\u00a0devastating conflict<\/a>\u00a0between the Sudanese Armed Forces (SAF) and the paramilitary Rapid Support Forces (RSF).<\/p>\n
