{"id":20087933,"date":"2024-06-05T14:26:55","date_gmt":"2024-06-05T12:26:55","guid":{"rendered":"https:\/\/www.dabangasudan.org\/?p=20087933"},"modified":"2024-07-10T15:07:04","modified_gmt":"2024-07-10T13:07:04","slug":"rules-with-no-lawyers-sudans-legal-professionals-detained","status":"publish","type":"post","link":"https:\/\/www.dabangasudan.org\/en\/all-news\/article\/rules-with-no-lawyers-sudans-legal-professionals-detained","title":{"rendered":"Rulings without lawyers: Sudan\u2019s legal professionals detained"},"content":{"rendered":"\n<p><strong>As the war between the Sudanese Armed Forces (SAF) and the <strong> Rapid Support Forces (RSF) <\/strong>rages into its 14th month, enforced disappearances and detentions of activists, neighbourhood volunteers, and professionals, especially lawyers, <strong>continue unabated<\/strong>. With both warring parties accusing civilians of aligning with the opposition, the risk <strong>for those who speak out against the war<\/strong> is growing. Human rights defender Amir Suleiman yesterday spoke with Radio Dabanga on the impact of \u2018this war with justice\u2019.<\/strong><\/p>\n\n\n\n<p>Suleiman explained how lawyers have been killed in crossfires throughout Sudan, while others fled their homes and found shelter in other parts of Sudan or managed to flee to neighbouring countries. Many, however, have been detained.<\/p>\n\n\n\n<p>Since the beginning of the war in April 2023, thousands of people, including a large number of lawyers, have been <a href=\"https:\/\/www.dabangasudan.org\/en\/all-news\/article\/unlawful-detentions-and-extrajudicial-killings-of-activists-continue-in-war-torn-sudan\" target=\"_blank\" rel=\"noreferrer noopener\">forcibly abducted<\/a>, with their whereabouts unknown. The abductors usually belong either from the RSF or SAF.<\/p>\n\n\n\n<p>Many are still languishing in <a href=\"https:\/\/www.dabangasudan.org\/en\/all-news\/article\/detentions-and-raids-continue-in-sudan-capital\" target=\"_blank\" rel=\"noreferrer noopener\">RSF detention centres<\/a>. Several of them have died as a result of torture, diseases, and hunger in Khartoum, El Gezira, and Darfur, for no particular reason. \u201cReports from relevant organisations confirm that there are many secret detention places where thousands of Sudanese are being held,\u201d lawyer Suleiman confirmed.<\/p>\n\n\n\n<p><strong>Under SAF control<\/strong><\/p>\n\n\n\n<p>In the so-called \u2018safe states\u2019, in northern and eastern Sudan, many displaced people have been subjected to <a href=\"https:\/\/www.dabangasudan.org\/en\/all-news\/article\/sudanese-authorities-detain-activists-in-el-gedaref\" target=\"_blank\" rel=\"noreferrer noopener\">arbitrary accusations<\/a>, of aiding or abetting the RSF, placing them in danger before the judicial authorities in Sudan. Suleiman expressed his deep concern about \u201cthese trials that violate the conditions of fair judicial proceedings\u201d.<\/p>\n\n\n\n<p>According to the human rights defender, judges in areas under SAF control are under significant pressure to convict those brought before them, especially if they are charged with being collaborating with the RSF.<\/p>\n\n\n\n<p>This was recently seen in Blue Nile region and Red Sea state. In the Ed Damazin Court a <a href=\"https:\/\/www.dabangasudan.org\/en\/all-news\/article\/sudanese-man-and-woman-sentenced-to-death\" target=\"_blank\" rel=\"noreferrer noopener\">death sentence<\/a> was issued against civil servant El Habib Eisa, after he was accused of \u201cundermining the constitutional order\u201d. He reportedly did not see a lawyer. In Port Sudan, a young woman was sentenced to death for allegedly cooperating with the RSF.<\/p>\n\n\n\n<p>On May 8, head of Sudan\u2019s Sovereignty Council and SAF Commander-in-Chief Lt Gen Abdelfattah El Burhan issued a \u201cconstitutional decree\u201d approving <a href=\"https:\/\/www.dabangasudan.org\/en\/all-news\/article\/sudanese-de-facto-govt-working-on-new-constitutional-framework\" target=\"_blank\" rel=\"noreferrer noopener\">amendments to the National Security Act<\/a> governing the work of the General Intelligence Service (GIS).&nbsp;The amended law broadens the powers of the security apparatus, including immunity from the courts.<\/p>\n\n\n\n<p>After the 2021 coup d\u2019etat in Sudan, <a href=\"https:\/\/www.dabangasudan.org\/en\/all-news\/article\/more-practices-from-al-bashir-era-reappearing-in-sudan\" target=\"_blank\" rel=\"noreferrer noopener\">reports of violent suppression of freedoms<\/a> that characterised the 30-year Al Bashir regime returned in all levels of society. Military Intelligence and GIS were given <a href=\"https:\/\/www.dabangasudan.org\/en\/all-news\/article\/resistance-committee-members-detained-as-sudan-s-gis-given-power-of-arrest\" target=\"_blank\" rel=\"noreferrer noopener\">free powers of detention<\/a> again, which has now become official in the amended security act.<\/p>\n\n\n\n<p><strong>Incommunicado<\/strong><\/p>\n\n\n\n<p>The African Centre for Justice and Peace Studies <a href=\"https:\/\/www.dabangasudan.org\/en\/all-news\/article\/acjps-sheds-light-on-ongoing-human-rights-atrocities-plaguing-sudan\" target=\"_blank\" rel=\"noreferrer noopener\">(ACJPS) report<\/a>ed in May that both the <a href=\"https:\/\/www.dabangasudan.org\/en\/all-news\/article\/sudans-warring-parties-detain-activists-hold-volunteers-incommunicado\" target=\"_blank\" rel=\"noreferrer noopener\">SAF and RSF<\/a> are targeting specific groups of activists, lawyers and journalists. The report further explains how torture and prolonged incommunicado detention, particularly <a href=\"https:\/\/www.dabangasudan.org\/en\/all-news\/article\/detentions-and-raids-continue-in-sudan-capital\" target=\"_blank\" rel=\"noreferrer noopener\">by the RSF<\/a>, targeting suspected members or affiliates of opposing factions, as well as ethnic minorities.<\/p>\n\n\n\n<p>Victims who have escaped or been <a href=\"https:\/\/www.dabangasudan.org\/en\/all-news\/article\/sudanese-authorities-detain-activists-in-el-gedaref\" target=\"_blank\" rel=\"noreferrer noopener\">released from detention<\/a> have recounted severe torture by both conflict parties in Sudan, aimed at extracting information or coerced confessions and to degrade or humiliate them. Torture methods include electric shocks, beatings with various objects, flogging, deprivation of basic needs like food and water, suspension in stress positions, and exposure to extreme weather conditions.<\/p>\n\n\n\n<p>In <a href=\"https:\/\/www.dabangasudan.org\/en\/all-news\/article\/sudanese-rights-groups-deliver-enforced-disappearance-reports-to-un\" target=\"_blank\" rel=\"noreferrer noopener\">March this year<\/a>, eight Sudanese human rights and civil society organisations, operating under the banner \u2018Wadeitum wein\u2019 (Arabic for \u2018<a href=\"https:\/\/www.dabangasudan.org\/en\/all-news\/article\/sudan-groups-launch-where-did-you-take-them-campaign-against-forced-disappearances\" target=\"_blank\" rel=\"noreferrer noopener\">Where did you take them<\/a>?\u2019), provided vital data on enforced disappearances to the United Nations High Commissioner for Human Rights in Geneva.<\/p>\n<div class=\"sws_supernormalaction\"><button style=\"color:#ffffff;background-color: #d52631;\" ><svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" class=\"superwebshare-svg\"  fill=\"currentColor\" viewBox=\"0 0 1000 1000\" stroke=\"currentColor\"
