Lawyers regret the move and call for reform of the justice system.<\/strong><\/p>\n\n\n\n<p>A number of Special Courts for Martyrs\u2019 Cases were created during the civilian-led government of PM Hamdallah Hamdok (2019-2021) to speed up the investigations and trials.<\/p>\n\n\n\n<p>In December 2020, when relatives of killed demonstrators <a href=\"https:\/\/www.dabangasudan.org\/en\/all-news\/article\/vigil-for-special-courts-for-martyrs-held-before-sudan-s-chief-justice\" target=\"_blank\" rel=\"noreferrer noopener\">staged a vigil in front of the Judiciary in Khartoum<\/a>, to demand the special courts to accelerate the remaining investigations, Supreme Court Judge Nemat Abdallah told them she herself had supervised the formation of the special courts\u2019 constellation composed of the best judges in the country.<\/p>\n\n\n\n<p>At the time, only three cases&nbsp;<a href=\"https:\/\/www.dabangasudan.org\/en\/all-news\/article\/start-of-investigations-on-sudan-s-june-3rd-massacre\" target=\"_blank\" rel=\"noreferrer noopener\">had been brought to court<\/a>.&nbsp;The reason for the delay in trials was because the authorities did not cooperate in lifting the immunities of the accused, Abdallah explained.<\/p>\n\n\n\n<p>In mid-December last year, the <a href=\"https:\/\/www.dabangasudan.org\/en\/all-news\/article\/supreme-court-rejects-sudanese-bar-association-reinstatement-appeal\" target=\"_blank\" rel=\"noreferrer noopener\">new head of the judiciary<\/a>, appointed following the\u202f <a href=\"https:\/\/www.dabangasudan.org\/en\/all-news\/article\/sudan-military-seizes-power-arrests-pm-and-civilian-ministers-in-dawn-coup\" target=\"_blank\" rel=\"noreferrer noopener\">coup d\u2019\u00e9tat<\/a> of October 2021, <a href=\"https:\/\/www.dabangasudan.org\/en\/all-news\/article\/vigil-for-special-courts-for-martyrs-held-before-sudan-s-chief-justice\">cancelled the special courts<\/a>.<\/p>\n\n\n\n<p>Asked about the transferral of the martyrs\u2019 cases to common criminal courts this week, lawyer Samir Sheikh Idris told Radio Dabanga that \u201cThese special courts however were established while the justice system was on the verge of collapse, and this was followed by the military coup. And we all know that the junta does not have the will to achieve justice for the martyrs&#8221;.<\/p>\n\n\n\n<p>He attributed the delay in handling the cases of excessive violence against protesters during the Revolution to \u201cfailures in the reform process of the justice system\u201d during the [2019-2021] transitional period.<\/p>\n\n\n\n<p>\u201cWhat is required now is a thorough reform of the judicial system and the existence of a real political will to achieve justice,\u201d he explained. \u201cIf these conditions are met, ordinary courts are just as able to consider these cases.\u201d<\/p>\n\n\n\n<p>The lawyer said that some of the criminal courts already looked into a number of complaints and \u201cwere able to achieve justice for them within a reasonable time due to the ingenuity of the judges who handled them, as <a href=\"https:\/\/www.dabangasudan.org\/en\/all-news\/article\/eight-sudanese-activists-acquitted-of-fabricated-and-malicious-charges-of-killing-officer\" target=\"_blank\" rel=\"noreferrer noopener\">happened earlier this week with the case dealing with the killing of an intelligence officer<\/a> and the accused protesters were acquitted\u201d.<\/p>\n\n\n\n<p>Lawyer Dafallah Ibrahim however regrets the abolition of the special courts. He told Radio Dabanga that the martyrs\u2019 cases should be dealt with by special courts.<\/p>\n\n\n\n<p>\u201cWitnesses will have less protection when they are requested to testify in ordinary courts, but more important is the specificity of these crimes,\u201d he said. \u201cThe reason for establishing special courts is that most of the accused are staff members of statutory bodies, so the cases cannot be be handled by an ordinary criminal court.\u201d<\/p>\n\n\n\n<p>Ibrahim further described the judiciary&#8217;s replacing judges in the <a href=\"https:\/\/www.dabangasudan.org\/en\/all-news\/article\/khartoum-judge-orders-criminal-case-against-kober-prison-director-in-trial-of-tortured-detainees-accused-of-stabbing-police-officer\" target=\"_blank\" rel=\"noreferrer noopener\">court case against a number of protesters charged with killing a police brigadier<\/a> in January last year as \u201ca dangerous development\u201d.<\/p>\n<div class=\"sws_supernormalaction\"><button on=\"tap:superwebshare-lightbox\" class=\"superwebshare_normal_button1 superwebshare-button-large superwebshare-button-square
